Rationale

Aviation operates within a very highly regulated environment. It is therefore important for aviation professionals (for example, pilots, engineer, air traffic controllers and other working personnel) to have a well-developed awareness and understanding of aviation laws and how they interact and impact on daily aviation activities so that they are appropriately managed. Although the overall Australian legal system and overview of legal theory are introduced, the course places a stronger focus on branches of law applicable to Australian aviation. This is the first of two courses on aviation law and it aims to provide the foundational understanding of Australian aviation law for the subsequent course (AVN3109 International Aviation Law).

Synopsis

Having a rigid understanding of the law and legal systems applicable to Aviation industry cannot be emphasised enough for those aviation personnel completing their day-to-day activities. In this course, students will be introduced with an overview of the aviation regulatory framework in Australia, development of the legal system in Australia, Legislation relating to Aviation and various branches of law applicable to Australian Aviation such as Contract law, Criminal law, Negligence and other Torts. The course also offers how aviation regulations are practised and administered including the roles and responsibilities of the regulator. The course will focus on a practical understanding of the legal implications associated with various aviation professionals' duties and accountabilities.

Objectives

On successful completion of this course students should be able to:

  1. explain the domestic and international aviation legal systems;
  2. outline the legal responsibilities of aviation regulators and other personnel;
  3. articulate the interrelated nature of the various branches of law applicable to Australian aviation;
  4. understand and demonstrate operational perspectives regarding the application of Australian aviation law.
