Synopsis

Family law is a major area of legal practice which also overlaps with important social issues. The course will focus on the main areas to equip students with the ability to practice in Family Law. In relation to children's issues the course will maintain a child-centred focus to give students direction as to the requirements of the courts and the community that the best interests of the child should be taken into account. The course will also focus on the dispute resolution processes that pertain to Family disputes in a changing policy and legal environment.

Objectives

On successful completion of this course students should be able to:

  1. Demonstrate [interpret and synthesise] an understanding of a coherent body of knowledge of family law, and the broader contexts in which family law issues arise (PO1, TLO1);
  2. Identify and articulate family legal issues, and apply legal reasoning and research to generate appropriate responses to family legal issues (PO3, TLO3);
  3. Demonstrate [apply] the intellectual and practical skills needed to identify, research, evaluate and synthesise relevant factual, legal and policy issues relating to family law (PO4, TLO4);
  4. Communicate family law issues in ways that are effective, appropriate and persuasive for legal and non-legal audiences (PO5, TLO5); and
  5. Identify applicable legislation and delegated legislation in family law, and deploy appropriate techniques in the course of solving interpretative problems in family law (PO7).

However, it is the students' responsibility to study all material provided to them or required to be accessed by them to maximise their chance of meeting the objectives of the course and to be informed of course-related activities and administration.

  2. Requirements for students to complete each assessment item satisfactorily:

    To satisfactorily complete an individual assessment item a student must achieve at least 50% of the marks. (Depending upon the requirements in Statement 4 below, students may not have to satisfactorily complete each assessment item to receive a passing grade in this course.)

  4. Requirements for student to be awarded a passing grade in the course:

    To be assured of receiving a passing grade a student must obtain at least 50% of the total weighted marks available for the course .

    To be awarded a passing grade for a supplementary assessment item (if applicable), a student must achieve at least 50% of the available marks for the supplementary assessment item as per the Assessment Procedure (point 4.4.2).

  5. Method used to combine assessment results to attain final grade:
    The final grades for students will be assigned on the basis of the aggregate of the weighted marks obtained for each of the summative assessment items in the course.
